1. Acceptance of Terms

By accessing and using SiteScope ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SiteScope provides a mobile and web application for professional project documentation, including photo management, AI-powered analysis, AR measurements, team collaboration, and reporting features.

3. Account Registration

You must register for an account to use certain features of the Service. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password
Accept all responsibility for activity that occurs under your account
Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Certain features require a paid subscription. By subscribing, you agree to:

Pay all applicable fees for your chosen subscription plan
Automatic renewal unless you cancel before the renewal date
Price changes with 30 days notice
No refunds for partial months or unused features

5. Acceptable Use

You agree NOT to:

Violate any laws or regulations
Infringe on intellectual property rights
Upload malicious code or viruses
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service
Use the Service for competitive purposes
Share your account credentials with others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by SiteScope and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you upload to the Service (photos, measurements, etc.). By uploading content, you grant us a license to use, store, and display your content solely to provide the Service.

7. Data Backup and Loss

While we take reasonable measures to backup your data, you are responsible for maintaining your own backups. We are not liable for any loss of data.

8. Limitation of Liability

USE OF THE SERVICE IS AT YOUR OWN RISK. To the maximum extent permitted by law, SiteScope shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

In no event shall SiteScope's total liability to you for all claims exceed the greater of (a) the amount you paid to SiteScope in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00).

SiteScope assumes no liability or responsibility for any: (i) errors, mistakes, or inaccuracies of content or measurements; (ii) personal injury or property damage resulting from your use of the Service; (iii) unauthorized access to our servers or your personal information; (iv) interruption or cessation of the Service; (v) bugs, viruses, or other harmful code transmitted through the Service; or (vi) any content or conduct of any third party using the Service.

9. Measurement and Analysis Disclaimer

All measurements provided by SiteScope, including but not limited to map-based measurements, AR (augmented reality) measurements, and any calculated areas, distances, or dimensions, are estimates for reference purposes only. These measurements should not be relied upon for precision work, legal purposes, construction specifications, or any application where accuracy is critical.

Measurement accuracy may be affected by various factors including but not limited to: GPS signal quality, device sensors, map data accuracy, satellite imagery resolution, user error, environmental conditions, and software limitations.

Similarly, any AI-powered analysis, notes formatting, or automated suggestions are provided for convenience and should be independently verified. SiteScope is not responsible for any decisions made or actions taken based on measurements or analysis provided by the Service.

For precise measurements, always consult a licensed professional surveyor or appropriate certified expert.

10. Indemnification

You agree to defend, indemnify, and hold harmless SiteScope and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any intellectual property or privacy right; (iv) any claim that your content caused damage to a third party; or (v) any third party's access to and use of the Service with your credentials.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We do not warrant that the results obtained from the use of the Service will be accurate or reliable, or that any defects in the Service will be corrected.

12. Third-Party Services

The Service may contain links to or integrate with third-party services, including but not limited to mapping providers, payment processors, and cloud storage services. SiteScope is not responsible for the content, accuracy, or practices of any third-party services. Your use of such services is at your own risk and subject to their respective terms and policies.

13. Service Modifications

SiteScope reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
