1. Agreement

These Terms of Use ("Terms") are an agreement between you and SiteScope LLC, an Arizona limited liability company ("SiteScope", "we", "us"), and cover your use of the SiteScope Tech website, mobile apps, and web app (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for a company, you agree on its behalf and confirm you have authority to do so. If your company has a signed agreement with SiteScope, that agreement controls where it conflicts with these Terms.

2. Eligibility and Accounts

You must be at least 18 years old to create an account. Keep your account information accurate and your login secure. You are responsible for activity under your account, and you should tell us right away if you think someone has used it without permission.

3. The Service

SiteScope helps you document and measure spaces: room scans and floor plans, point clouds, photoreal walkthroughs, photos and notes, map measurements, exports, takeoffs, quotes, share links, guest scanning, and team workspaces. We may add, change, or remove features. Features labeled beta or preview may be less reliable and may change or end at any time.

4. Plans, Billing, and Cancellation

We offer a free plan and paid plans, with features and limits described in the app and on our website. Paid plans renew automatically until canceled.

App Store and Google Play: purchases are billed by Apple or Google under their terms. Cancel in your Apple or Google account settings at least 24 hours before renewal. Refunds are handled by Apple or Google.
Web and Business plans: billed by us through Stripe, in advance, and non-refundable except where required by law or a signed agreement. We will give you at least 30 days notice of a price change.
Cancel or downgrade: paid features end at the end of the billing period. Existing projects stay viewable, but anything beyond your new plan's limits may be unavailable.

5. Your Content

You own the scans, photos, measurements, notes, and other content you capture or upload ("Your Content"), and the files you export. You give us a limited license to host, process, convert, display, and transmit Your Content only as needed to provide the Service to you, including running features you choose (such as AI features) through our service providers and showing content to people you share it with.

Content in a team workspace belongs to that team and stays with it if a member leaves. Anyone with a share link can view what it shares, subject to any password, email, or expiration you set, so share carefully. Content a guest scans from your invitation is delivered to your project, and you are responsible for inviting only people who can lawfully scan that space.

6. Acceptable Use

You agree not to:

Break the law or infringe anyone's rights
Scan, photograph, or record a property or person without the permission the law requires
Share content you do not have the right to share, or that exposes someone's private information without consent
Access the Service without authorization, bypass share link protections or plan limits, or interfere with the Service
Upload malicious code, or scrape, reverse engineer, or resell the Service except where the law or a signed agreement allows
Use the Service or its output to build a competing product or train a competing AI model

7. Measurements, Estimates, and Professional Judgment

SiteScope is a tool. It does not replace your professional judgment or a licensed surveyor, architect, engineer, or inspector. Measurements, plans, models, exports, takeoffs, estimates, and AI output are estimates. They are not survey grade, certified, or checked for code compliance, and their accuracy depends on your device, the space, how it was scanned, and your edits.

Verify every dimension that matters before you order materials, fabricate, bid a fixed price, submit for a permit, or build. Quotes and estimates you create are your own work, and SiteScope is not a party to your agreements with your customers. AI output, including AI-drafted floor plans, can be wrong and should be reviewed before you rely on it.

8. Third-Party Services and Exports

The Service relies on third-party platforms and providers, including Apple, Google, mapping, AI, cloud, and payment services, and their terms apply to your use of them. Exported files (such as IFC, DXF, E57, GLB, and PDF) are provided in the formats we support. We do not guarantee how they behave in any particular version of third-party software, so check them in your own tools.

9. Our Service and Feedback

SiteScope owns the Service, including its software, design, and branding. These Terms do not give you any rights in them beyond using the Service. If you send us feedback or ideas, we may use them without obligation to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise the Service will be uninterrupted, error free, or that results will be accurate. Keep your own copies of anything important.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SITESCOPE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. This includes the cost of materials, labor, rework, delays, or lost bids that result from relying on measurements, estimates, or AI output without verifying them.

SiteScope's total liability for all claims is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50. Some jurisdictions do not allow these limits, so they apply only as far as the law allows.

12. Indemnification

You will defend and indemnify SiteScope and its members, officers, and employees against claims, losses, and costs (including reasonable attorney fees) arising from your use of the Service, Your Content, your violation of these Terms or anyone's rights, or any estimate, quote, design, or construction decision you or your customers make using the Service.

13. Termination

You can stop using the Service and delete your account in the app at any time. We delete Your Content within 30 days, except backup copies that expire on our normal schedule, information we must keep by law, and content that belongs to a team workspace. We may suspend or end your access if you break these Terms or to protect the Service or other users.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Arizona, and you and SiteScope consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms. We will post the new version here and update the date above, and for material changes we will also notify you by email or in the app before they take effect. Using the Service after that means you accept the updated Terms.

16. General

These Terms, the Privacy Policy, and any signed agreement with SiteScope are the entire agreement about the Service. If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale.

Apple. If you use our iOS app, these Terms are between you and SiteScope, not Apple, and SiteScope is responsible for the app, its support, and any claims about it. Your license is limited to Apple-branded devices you own or control, as the App Store terms allow. If the app fails a warranty, you may notify Apple for a refund of any purchase price; Apple has no other warranty obligation. You confirm you are not in a U.S.-embargoed country or on a U.S. restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms.
